Terms of Service

The client represents to us that it has the rights to photograph the location, building, or real estate that is the subject of this shoot. Apex Images is given permission to be on-site for purposes of providing our services.

All photos are at the discretion of the photographer unless specific requests have been mentioned during booking.  The photographer will not move furniture or other items during the shoot and will not stage or clean the home.  Any items that are not wanted in the photos must be stored out of sight.

Apex Images will edit photos and make reasonable efforts to honor client requests related to editing preferences. However, extensive editing or item removal may incur an additional charge, which will be discussed with the client prior to proceeding.  We are unable to honor requests that would misrepresent the real estate or location in any manner that violates MLS rules or which could constitute false advertising.

Payment for photography services is due upon receipt of the invoice, which will be emailed to the email address provided after photos have been taken.  Images and video will be delivered to client after payment is received in full, usually within 24 hours, but no more than 48 hours.

Copyright and Usage

All photographs, video, aerial imagery, floor plans, and other media created by Apex Images remain the copyrighted intellectual property of Apex Images unless otherwise agreed to in writing. Payment for photography services does not constitute a purchase or transfer of copyright.

Apex Images grants the client who books and purchases the media a non-exclusive, non-transferable license for the specific use for which the media was commissioned. Usage rights may not be sold, transferred, assigned, sublicensed, or otherwise extended to another individual, real estate agent, brokerage, business, or third party without written authorization from Apex Images.

For photography commissioned by a real estate agent or brokerage, the commissioning agent or brokerage is granted a license to use the media to market the property for the duration of that listing, including MLS, websites, social media, print advertising, and other property-marketing purposes. The original listing agent may also retain the media for their own portfolio and self-promotional use after the property is sold or the listing has ended. The license does not transfer to another agent or brokerage if the listing changes representation.

For photography commissioned directly by a homeowner, the homeowner is granted a license for their own personal use and any specifically agreed-upon property-marketing purposes. This license does not grant usage rights to a real estate agent, brokerage, property manager, builder, designer, contractor, or other commercial third party. Any third party wishing to use the media must obtain a separate license directly from Apex Images.

Apex Images retains the right to use media it creates for portfolio, advertising, promotional, and other lawful business purposes.
